Whenever you use The Rental Journal Job Board (“Website”) online, you represent that you have read and agree to the Terms of Service (“Agreement”) set forth below with The Rental Journal Pty Ltd (“The Rental Journal”). All references to “you” or “your” shall mean everyone other than The Rental Journal — you, the Applicant, or Employer using The Rental Journal in any capacity. You are a person at least eighteen years-old and legally able to enter into a contract.

The Rental Journal is dedicated to providing a website for people searching for jobs (“Applicants”) or people/businesses trying to fill open positions (“Employers”). Legally speaking, other than access to the website, you get nothing else. You assume all risk.

The Rental Journal reserves the right to revoke anyone’s access to the Website at any time, for any reason whatsoever, without notice.

Employers

If you represent an Employer, you warrant that you have the authority to agree to this Agreement on behalf of yourself and your Employer.

As an Employer, you acknowledge that all information submitted on the Website is accurate and that you have the legal authority to act on behalf of your Company. You are solely responsible for all information listed on your Company Page.

The Rental Journal does not allow the posting of any discriminatory Job Postings.

The Rental Journal may reject or remove Job Postings or Company Pages at any time for any reason whatsoever.

The Rental Journal is not required to verify the identity or information of any Applicant. The Rental Journal will not verify any information listed on Company Pages.

While The Rental Journal will not charge Applicants to use the Website, The Rental Journal may charge Employers for the privilege to create Job Postings and use the platform and may charge a fee to advertisers. All Job Postings are considered advertising.

Applicants

By creating a profile and uploading a resume to the Website, you are authorizing The Rental Journal to provide any Employer with your resume or information for the sake of finding you a job. The Rental Journal assumes no responsibility or liability for the accuracy or completeness of your profile and resume.

By providing The Rental Journal with your email, you are authorizing The Rental Journal to send you Job Postings that may align with what type of job you’re seeking based on the information on your profile and resume.

When you apply for a Job Posting, you are authorizing The Rental Journal to share your information with any Employer who may be interested. We do not guarantee a job nor even any responses or job offers from Employers. We do not provide any assurances regarding the validity of the Employer, its information or any offers made. Applicants are solely responsible for validating all communications and offers from Employers.

General Conditions

If you are using this Website for any other purpose other than to find a job or post a job, The Rental Journal will revoke your access privileges without notice. Commercial use and extracting data from The Rental Journal Jobs are prohibited.

The Rental Journal owns a copyright in the Website and owns the rights to all photographs, videos, visual elements, copy, and design of the Website.

The Rental Journal may make changes to or modify, waive, or increase fees to use the Website at any time for some or all users.

When you submit information on The Rental Journal Job Board, The Rental Journal may store and utilize your information to improve our services and Website. The Rental Journal will not sell your data to third parties.

No user is allowed to post any content that’s defamatory, offensive, official identification, or a solicitation.

By providing your email address, you agree that The Rental Journal may send you useful communications regarding available Job Postings and other opportunities on the Website.

Liability

The Rental Journal has no liability or responsibility for any content found on the Website that’s submitted by Applicants or Employers.

Third parties make all job Postings, and The Rental Journal has no control or responsibility for the content of Job Postings, their accuracy, or anything that may happen once an Applicant has left the Website.

Website May Be Inoperable

The Website may be down or inoperable from time-to-time. The Rental Journal makes no assurances regarding its operation, availability or reliability. The Rental Journal reserves the right to refuse service to anyone or to cancel user access at any time.

No Warranties

The Rental Journal has no obligations or continuing obligations. This material, website and content may be changed at any time without notice. THE WEBSITE AND CONTENT ARE PROVIDED “AS IS” AND THERE ARE NO WARRANTIES WHATSOEVER, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

Disclaimer and Indemnification

YOU THE USER ASSUME ALL RISK. You irrevocably and unconditionally waive, release, exonerate and indemnify The Rental Journal and its members, managers and agents from any and all claims, causes of action or liability whatsoever resulting from your use of this website and any content. In no event will The Rental Journal and its members, managers or agents be liable for any loss or damage whatsoever (including any damage to your computer, computer system or loss of data) whether direct or indirect, incidental or consequential, special or otherwise.

Use of User Data

We use Hotjar in order to better understand our users’ needs and to optimize this service and experience. Hotjar is a technology service that helps us better understand our users’ experience (e.g. how much time they spend on which pages, which links they choose to click, what users do and don’t like, etc.) and this enables us to build and maintain our service with user feedback. No Relationship Exists or is Formed

The Website is provided for general information only. There is no employer-employee relationship or any other legal relationship that exists or is formed. Any claim, dispute or litigation arising out of this Agreement or its performance, will be solely resolved using binding arbitration. This agreement is governed by the laws of New South Wales, Australia.
